Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the Jooniya mobile application (“Application”) and related services.
By accessing or using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.
1. Definitions
- Application means the mobile software program branded as “Jooniya”.
- Owner refers to the individual proprietor operating and managing the Application.
- Service refers to the online platform enabling users to browse restaurant listings, place food orders, and facilitate delivery services.
- Restaurant Partner means independent third-party restaurants or vendors listed on the Application.
- Delivery Partner means independent third-party personnel responsible for delivering orders.
- User, You, or Your refers to any individual using the Application.
- Country refers to India.
2. Nature of the Platform
Jooniya is a technology-based intermediary platform operated by an individual proprietor.
The Owner does not prepare, cook, manufacture, store, or package food items. All responsibilities relating to food quality, safety, hygiene standards, and regulatory compliance rest solely with the respective Restaurant Partner.
3. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under applicable Indian law to use the Service.
4. User Account and Security
You agree to provide accurate and complete information while creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
5. Orders and Acceptance
All orders placed through the Application are subject to acceptance by the respective Restaurant Partner. The Owner does not guarantee order acceptance.
6. Payments
Payments are processed through third-party payment gateways. The Owner does not store full debit/credit card details and is not responsible for:
- Payment failures due to banking issues
- Transaction declines
- Unauthorized transactions caused by user negligence
7. Pricing and Taxes
Prices are determined by Restaurant Partners and may change without prior notice. Applicable taxes and delivery charges will be displayed before order confirmation.
8. Cancellation and Refund Policy
Orders may not be canceled once preparation has commenced. Refunds, if applicable, will be processed within 5–7 business days depending on the payment method used.
The Owner reserves the right to refuse refunds in cases of misuse or fraudulent activity.
9. Delivery
Delivery times are estimates and may vary due to traffic, weather conditions, restaurant delays, or unforeseen circumstances. The Owner does not guarantee exact delivery times.
10. Location Services
The Application uses real-time location data to provide essential features including:
- Displaying nearby restaurants
- Detecting accurate delivery addresses
- Order tracking functionality
- Improving service availability
By using the Application, you consent to the collection and use of your location data for the purposes described above.
You may disable location permissions at any time through your device settings; however, certain features of the Application may not function properly without location access.
The Owner does not sell or rent precise location data to unauthorized third parties. Location data is used strictly for operational and service-related purposes.
11. User Conduct
You agree not to:
- Provide false information
- Abuse delivery personnel or restaurant staff
- Engage in fraudulent transactions
- Misuse promotional offers
- Attempt to disrupt the Application’s functionality
12. Intellectual Property
All trademarks, logos, branding, design elements, and software associated with the Application are the intellectual property of the Owner or respective licensors. Unauthorized use is strictly prohibited.
13. Limitation of Liability
To the maximum extent permitted by law, the Owner shall not be liable for:
- Food quality issues
- Allergic reactions
- Indirect or consequential damages
- Loss of profits or data
Total liability shall not exceed the amount paid by the User for the specific order in dispute.
14. Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts in India.
16. Termination
The Owner reserves the right to suspend or terminate access to the Application for violations of these Terms.
17. Changes to Terms
The Owner may modify these Terms at any time. Continued use of the Application after updates constitutes acceptance of the revised Terms.
