1. Interpretation and Definitions
Definitions
- Application means the mobile software program named “Jooniya”.
- Service refers to the food ordering, restaurant listing, and delivery facilitation services provided through the Application.
- Restaurant Partner means third-party restaurants, food vendors, or merchants listed on the Application.
- Delivery Partner means third-party personnel responsible for delivering orders.
- User or You means any individual who accesses or uses the Application.
- Country refers to India.
2. Nature of Service
Jooniya is a technology platform that connects Users with Restaurant Partners and Delivery Partners. The Company does not prepare, manufacture, cook, or store food items.
All food items, menu descriptions, pricing, offers, preparation methods, hygiene standards, and packaging are the sole responsibility of the respective Restaurant Partner.
3. User Eligibility
You must be at least 18 years old to use the Service. By using the Application, You represent that You are legally capable of entering into a binding contract under applicable law.
4. Account Registration
You agree to provide accurate and complete information while creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
5. Orders and Payments
All orders placed through the Application are subject to acceptance by the respective Restaurant Partner.
Payments are processed through third-party payment gateways. The Company does not store full debit/credit card details.
The Company is not responsible for:
- Payment failures due to banking issues
- Transaction declines
- Unauthorized transactions caused by User negligence
6. Pricing and Taxes
Prices displayed in the Application are determined by Restaurant Partners and may change without prior notice. Applicable taxes and delivery charges will be displayed before order confirmation.
7. Cancellation and Refund Policy
Orders once confirmed may not be canceled after restaurant preparation has started.
Refunds, if applicable, will be processed in accordance with Our Refund Policy and may take 5–7 business days depending on the payment provider.
The Company reserves the right to refuse refunds in cases of policy misuse or fraudulent activity.
8. Delivery
Delivery times are estimates and may vary due to traffic, weather, restaurant delays, or unforeseen circumstances.
The Company does not guarantee exact delivery times and is not liable for delays beyond reasonable control.
9. Location Services
The Application may access real-time location data to provide delivery tracking and service availability. You may disable location permissions through your device settings, but certain features may not function properly.
10. User Conduct
You agree not to:
- Provide false information
- Abuse delivery personnel or restaurant staff
- Engage in fraudulent transactions
- Misuse promotional offers
- Attempt to disrupt the Application’s functionality
The Company reserves the right to suspend or terminate accounts violating these rules.
11. Intellectual Property
All trademarks, logos, branding, software, and content in the Application are the property of the Company or respective partners. Unauthorized use is strictly prohibited.
12. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for:
- Food quality issues
- Allergic reactions
- Indirect or consequential damages
- Loss of profits or data
Our total liability shall not exceed the amount paid by You for the specific order in dispute.
13. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts located in India.
15. Termination
We may suspend or terminate Your access to the Service at any time for violation of these Terms.
16. Changes to Terms
The Company reserves the right to modify these Terms at any time. Continued use of the Application after updates constitutes acceptance of the revised Terms.
